The purpose of this policy is to:

  1. Establish a zero -tolerance environment for sexual abuse in the 3B Juvenile Detention Center
  2. Make the prevention of sexual abuse a top priority in 3B
  3. Develop and implement practices which comply with the National Standards to Prevent, Detect and Respond to Prison Rape published by the USDOJ on 6/20/12
  4. Make available any data and information on the incidence of sexual abuse in 3B
  5. Include the standardized definitions in 3B policies
  6. Clearly identify and express the accountability of all 3B staff, including the Director, when dealing with incidents of sexual abuse
  7. Protect the Eighth Amendment rights of juveniles in the custody of the 3B
  8. Increase the efficiency and effectiveness of programs within 3B by providing a safe environment for juveniles to be free from sexual abuse within the facility

Or you may call the Bonneville County Prosecuting Attorney or the Bonneville County Sheriff’s Office. You may also report by contacting Rape Crisis Day: (208) 529-4352 – Night: (208) 235-2412. Please have any information or evidence available for the investigator who will be assigned to handle the case. False accusations may be prosecuted. All reports are taken seriously and investigated as outlined in PREA Policy.

PREA STANDARDS

The Prison Rape Elimination Act (PREA) was passed in 2003 with unanimous support from both parties in Congress. The purpose of the act was to “provide for the analysis of the incidence and effects of prison rape in Federal, State, and local institutions and to provide information, resources, recommendations and funding to protect individuals from prison rape.” (Prison Rape Elimination Act, 2003). In addition to creating a mandate for significant research from the Bureau of Justice Statistics and through the National Institute of Justice, funding through the Bureau of Justice Assistance and the National Institute of Corrections supported major efforts in many state correctional, juvenile detention, community corrections, and jail systems.

PREA Data Review

In compliance with Section 115.388 of the PREA Standards, 3B Juvenile Detention Center has reviewed data collected and aggregated pursuant to section 115.387 in order to assess and improve the effectiveness of its sexual abuse prevention, detection, and response policies, practices, and training, including;

  • Identifying problem areas,
  • Taking corrective action on an ongoing basis,
  • Preparing an annual report of its findings and corrective actions,

In compliance with Section 115.389 of the PREA Standards, 3B shall make all aggregated sexual abuse data readily available to the public at least annually.
